New Regulations for Working Retirees in Germany Begin in 2027

Working retirees who wish to maintain their statutory sickness benefits must adjust their partial pensions before the upcoming deadline.

A significant regulatory change is approaching for retirees in Germany who continue to work alongside collecting their retirement benefits. Due to the statutory health insurance contribution rate stabilization law, the legal entitlement to sickness benefits will face stricter limitations starting January 1, 2027.

The German Pension Insurance has raised awareness about the upcoming transition, noting that individuals who want to preserve their sickness benefit coverage may need to take action before the end of the year. The new policy primarily affects employed individuals who previously chose to draw nearly their entire retirement payment as a partial pension.

Under current rules, working retirees have been able to receive 99.99 percent of their regular pension while keeping their statutory sickness benefit eligibility intact. For a monthly full pension of 2,000 euros, this meant giving up a mere 20 cents to secure coverage under the proper insurance conditions.

Beginning January 1, 2027, this practice will no longer be possible. The entitlement to sickness benefits will be rescinded if a retiree's partial pension accounts for more than two thirds of their full pension amount. Consequently, anyone wishing to retain sickness benefits must limit their partial pension payout to a maximum of 66.66 percent.

The financial implications of this adjustment can be substantial. Using a 2,000 euro monthly pension as an example, a retiree would previously receive 1,999.80 euros while retaining sickness insurance. Under the 2027 regulations, reducing the partial pension to the required threshold would lower monthly payouts to 1,333.20 euros, resulting in an immediate monthly decrease of roughly 667 euros.

While the reduction in pension payments is steep, it preserves the right to receive sickness compensation during prolonged illnesses. This protection becomes vital once employer-provided wage continuation ends, which typically occurs after six weeks of medical leave, thereby preventing a severe income gap for workers.

The German Pension Insurance emphasizes that affected individuals must submit their formal requests by December 31, 2026, if they want the adjustment to take effect on the first day of 2027. Applications can be submitted in writing or through the online services provided by the pension authority.

Authorities recommend that retirees carefully evaluate their financial circumstances before making changes, as reducing a partial pension requires sacrificing a significant portion of monthly income. Standard retirees who do not work or hold jobs without sickness benefit eligibility are not affected by the upcoming policy shift.
